What happens if I am convicted of DUI while driving within 1,000 feet of school property, including a school crossing zone?

It is not a defense that you did not know that you were within 1,000 feet of school property or while driving through a school crossing. It is also not a defense that no minors were present on the school property or crossing zone at the time of the offense or that the school was not in session. The penalties are enhanced from a regular DUI. They differ in the following respects: For a first offense, you will be fined from $1294 to $1594. You will be sentenced to up to 60 days in jail. Your driver’s license will be suspended for a period of one to two years. If your BAC is less than .15% you may be forced to install an interlock device for six months to a year after the end of your license suspension. If your BAC is .15% or greater you will be forced to install an interlock device for six months to a year after the end of your license suspension For a second offense, you will be fined $1,894 to $2894. You must perform community service for a period of 60 days. You will be sentenced to four to 180 days in jail, however, up to 90 days may be done through community service. Your driver’s license will be suspended for 4 years. For a third offense, you will be fined $2,894. You will be sentenced to 180 days in jail. You will lose your driver’s license for 20 years. The period of license suspension begins after you have completed any prison sentence imposed upon you. All other consequences remain the same, including the total insurance surcharge of $3,000 payable in three annual payments of $1,000.
