DUI blood tests vs breath samples in N.J.S. 39:4-50 Breath testing estimates the amount of alcohol in your blood stream by carrying out several calculations involving the air you breath out into a machine call the Alcotest in New Jersey.  Blood tests if performed properly and analyzed correctly is more definitive because it is testing your blood rather than extrapolating the amount of alcohol through your breath.  The limit of alcohol in your blood in New Jersey is the same for both tests, .08%. Anything over this amount you are considered legally drunk.The exception is if you are driving on a public road and under the age of 21. In which case, any amount of alcohol in your system is will result in you being charged with underage drinking and if over the .08%  also with a DUI
