There is no one-year deadline to filing. You may be eligible to apply for Withholding of Removal even if you have a criminal past, and are currently in immigration detention. However, it is possible that you may be deported to a third country you may have ties with. After this relief is granted, you cannot return to the U.S. if you leave.
