For the purposes of this process, a significant misdemeanor is

a. a misdemeanor (maximum jail is one year or less but more than five days); and

b. Is NOT an offense of domestic violence; sexual abuse or exploitation; burglary; unlawful possession or use of a firearm; drug distribution or trafficking; or, driving under the influence; and

c. Custody was 90 days or less.

The time in custody does being held solely because a law enforcement agency is honoring a detainer, will not be counted against you.
