Approximately twenty four states have sued the government to prevent you from applying for President Obama’s November 20, 2014. The matter before Judge Hagen in Texas was filed in a district with only two civil judges and one with known anti-immigrant views. Since Texas filed that lawsuit over twenty other states have joined in. As I have argued in prior posts, this lawsuit ultimately won’t be successful. If Judge Hagen allows for a temporary injunction, the law is clear on the subject and the appellate courts won’t be as partisan minded when they review the law.The House of Representative approved a bill to fund the Department of Homeland Security but attached riders that defund the Executive Action program. Yesterday, the Senate failed to overcome a procedural hurdle and the Senate version of that bill will not become law. The House of Representative has also threatened a lawsuit against the President over his Executive Action, but it has yet to be filed. The combination of these initiatives is to cause fear. To keep you from applying for the protection you deserve. If you qualify and don’t apply you are allowing the Republican’s fear mongering to succeed. What President Obama has done is a temporary reprieve. But for many, it is the only option they have. For others, they have options but either never did anything about it or never knew about it. Just yesterday I met with a client for Deferred Action for Parental Accountability (DAPA) and it turns out he qualifies for a U-Visa (legal status for victims of qualifying crimes) and had for the last five years but didn’t know about it. Take the time and find out your options. If you qualify for some relief, even if only DAPA, don’t wait get started today. Don’t let the Republicans intimidate you.
